Terms of service


1. Introduction

This User Agreement (the "Agreement") is a contract between you and Amedex Pty Ltd ("Amedex", "we", "us", "our"), governing your access to and use of amedex.com.au and the Amedex App (together, the "Service"). By creating an account or subscribing to the Service, you agree to be bound by this Agreement. If you do not agree, you must not access or use the Service.

This Agreement may be updated from time to time. We will notify you of material changes by email or by notice on the Service. Continued use of the Service after such notice constitutes acceptance of the updated terms.

2. Nature of the Service

Amedex is a commercial provider of online educational materials to assist medical graduates preparing for the Australian Medical Council ("AMC") MCQ CAT examination. Amedex is not affiliated with, endorsed by, or associated with the AMC, any medical licensing authority, or any medical school. Content is provided as a study aid only, is not a guarantee of exam performance, and is not intended for use in clinical or medical practice. You should seek independent professional advice where appropriate.

3. Eligibility and Account Registration

To subscribe, you must provide accurate and current registration information and choose a password. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately of any unauthorised use of your account. We are not liable for losses arising from unauthorised use of your account unless caused by our negligence; however, you may be liable for losses we or others suffer as a result of unauthorised use arising from your failure to safeguard your credentials.

4. Licence to Use Content

Subject to your payment of applicable fees and compliance with this Agreement, Amedex grants you a limited, non-exclusive, non-transferable, non-sublicensable licence to access and use the licensed materials for the specific course(s) you have subscribed to, for personal study purposes only, during your subscription period. You obtain no ownership rights in the licensed materials.

5. Content Protection Measures

To protect our intellectual property, pages within the Service use browser-based scripting to disable certain functions while you are viewing subscription content, including right-click context menus, text selection, and keyboard shortcuts for copying, printing, or saving page content. These measures operate only within the Amedex website/app interface in your browser and do not access, monitor, or control your device, other software, your operating system clipboard, or other applications.

These measures are not guaranteed to be effective in all circumstances (for example, screenshots taken through operating-system-level tools are not prevented by page-level scripting). You agree not to attempt to circumvent these measures or to otherwise copy, capture, record, reproduce, or redistribute licensed materials outside the permitted use in Clause 4, except where specific content is expressly made shareable by us (for example, via designated social media sharing functions).

6. Prohibited Conduct

You must not:

  • copy, reproduce, reverse-engineer, or modify licensed materials, or make them available on any other website, forum, file-sharing service, or platform;

  • share, sell, sublicense, or transfer your account or password to any third party, or permit simultaneous use of a single account by multiple people;

  • use any tool or process to interfere with the proper operation of the Service; or

  • use abusive, threatening, or harassing language toward Amedex staff or other users.

7. Breach and Account Action

Where we reasonably believe you have breached Clause 6, we may take action proportionate to the breach, which may include issuing a warning, suspending, or terminating your account. For serious breaches (including unauthorised redistribution of content or multiple confirmed instances of account sharing), we may suspend or terminate your account without prior warning. Where an account is terminated for breach, no refund will be provided for the remaining subscription period, without limiting your rights under Clause 10. We reserve the right to pursue any other legal remedy available to us, including for breach of contract or copyright infringement.

8. System Requirements and Availability

The Service is designed to operate on desktop or laptop computers running Windows 10+ or macOS that meet the minimum system requirements (available at https://amedex.com.au/faq). We make reasonable efforts to support other devices, but do not guarantee functionality on devices that do not meet the minimum requirements. A stable internet connection is required; you are responsible for any data charges incurred through your use of the Service. We do not guarantee uninterrupted availability and may suspend access for scheduled maintenance or matters outside our reasonable control. If we discontinue the Service other than for your breach, you will receive a pro-rata refund for the unused portion of your subscription.

9. Fees and Payment

Fees for each course/package and its subscription duration are as displayed at the time of purchase. Payment is processed by third-party payment providers; we do not store full payment card details. Once activated, a subscription period runs continuously and cannot be paused, placed on hold, or extended.

10. Refunds and Consumer Guarantees

10.1 Demo access. We provide free demo materials so you can evaluate whether the Service meets your needs before purchasing. We recommend you use this demo before subscribing.

10.2 No refund policy. Except as set out in this Clause 10 or as required by law, subscription fees are non-refundable once a subscription has been activated, including where you decide not to use, or do not complete use of, the subscribed materials.

10.3 Australian Consumer Law. Nothing in this Agreement excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred on you under the Australian Consumer Law (or other applicable law) that cannot lawfully be excluded, restricted, or modified. Where our Service fails to meet a consumer guarantee under the Australian Consumer Law, you may be entitled to a remedy including a refund, replacement, or compensation, and this Agreement does not limit that entitlement.

11. Intellectual Property

All content on the Service, including questions, explanations, video, audio, text, and design elements, is owned by or licensed to Amedex and protected by copyright and other intellectual property laws. Except as expressly permitted, no part of the Service may be reproduced, distributed, or used for commercial purposes without our prior written consent.

12. Disclaimers

The Service is provided as an educational study aid only. We do not guarantee any particular exam outcome. Other than guarantees that cannot be excluded under the Australian Consumer Law, the Service is provided "as is" without warranties of any kind, and we are not liable for your reliance on any information, opinion, or advice provided through the Service, including content contributed by third parties.

13. Limitation of Liability

To the maximum extent permitted by law, and subject to Clause 10.3, our total liability arising out of or in connection with your use of the Service, however arising, is limited to the amount of fees you paid for the relevant subscription in the 12 months preceding the claim. We exclude liability for indirect, consequential, or special loss to the extent permitted by law.

14. Privacy

Our collection and handling of your personal information is governed by our Privacy Policy, which forms part of this Agreement.

15. Governing Law

This Agreement is governed by the laws of Queensland, Australia, and the parties submit to the non-exclusive jurisdiction of its courts.
